The short version:

We believe that your health information is private information. On our site you will have complete control over how much is made available to other users. We will do our best to ensure your data is kept private but ultimately, you are responsible for keeping your information private. For example, we discourage the use of recognizable user names and never reveal your actual name unless you authorize it first. On the other hand, if you chose a user name that is the same as your real name, we can’t stop you. If you then post how wonderful your Bunion removal doctor was, don’t be surprised if someone comes along and asks how your bunions are doing. We maintain no responsibility for the privacy of your information but we promise to do our best to keep it private. You can help in several ways and we ask that you do so.

FAIRCARE, LLC, a New York limited liability company, created the FairCareMD Web Site Privacy Policy in order to ensure the confidence of visitors and customers of and to our Web site (the “Site”) and to establish certain terms and conditions of your use of the Site. The following Privacy Policy is designed to help you understand how we collect, use, and protect your information. Let’s get these out of the way first: Definitions: FairCare, LLC is “us”, “we”, “our”, and sometimes “The Company”. You are the “visitor”, “user”, or “the customer”. FairCareMD.com is “the site.”

1. Types of Information Collected

a. Traffic Data Collected. We automatically track and collect information when you visit our Site, including, without limitation, your: (i) IP address; (ii) domain server; (iii) type of computer; and (iv) type of web browser (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving your experience on the Site. We also use “cookies” to customize content specific to your interests, to ensure that you do not see the same advertisement repeatedly and to help your computer store your password so you do not have to re-enter it each time you visit the Site.

b. Personal Information Collected. In order for you to access certain services that we offer via the Site, including the ability to make deals for medical care, we require you to provide us with information that personally identifies you (“Personal Information”). Personal Information may include: (i) Contact Data (such as your name, mailing and e-mail addresses); (ii) Financial Data (optional) such as your account or debit card number; and / or (iii) Demographic Data (such as your zip code, family member ages, and income). Once you register with the site, you will also have the option to indicate the types of medical services you have an interest in (Health Interests.) Health Interests are the types of medical providers and services you would like to learn more about in your area, including, without limitation, physician office visits, diagnostic tests and prescription drugs. If you communicate with us by e-mail, post messages to any of our chat groups, bulletin boards or forums, or otherwise complete online forms, surveys or contest entries, any information provided in such communication may be collected as Personal Information.

2. Uses of Information Collected

We use Contact Data to send you information about our company, our products or services, to send you promotional material from some of our subscribers or to contact you when necessary. Only if you are acquiring services that require FairCareMD’s payment processing services will we utilize your Financial Data to facilitate electronic payment for those products or services. In such cases, your information will be entered directly into the credit card processor’s services and not stored in our system. We use your Demographic Data and Health Interest information to customize and tailor your experience on the Site, displaying content that we think you might be interested in and allowing providers (if authorized by you) with offers that fit your Health Interest criteria to send you offers for products and services. For example, if you indicate that you need a Dentist within 5 miles of your home or work address and a Dentist who fits your criteria is looking for new patients, you might get an offer from the Dentist.

3. Sharing of Personal Information

We only share Demographic Data with (a) physicians and other health care providers whom you have authorized to access the information and (b) advertisers and other third parties on an aggregate basis. “Aggregate basis” means that we may combine information from many users to provide summary level data without identifying the individual users. We will only use Contact Data when FairCareMD needs to send you information about our Services or Site. We will not share your Contact Data with any third parties. Allowing Providers to send offers based upon your approved Health Interests will not give access to your information, it only allows the provider to send information to you. Only after you respond to such an offer will the provider be able to contact you directly.

4. User Choice Regarding Collection, Use and Distribution of Personal Information

You may choose not to provide us with any Personal Information. If you do choose not to provide us with Personal Information, you can still access and use much of the Site; however, you will not be able to access and use those portions of the Site that require your Personal Information, including the Payment System and some offers from Providers that require access to demographical information (usually the big ticket items like major surgery). Remember, Personal Information will only be used by us to contact you regarding the FairCareMD Site and Services and will not be shared with any third parties unless otherwise indicated.

5. Confidentiality and Security of Personal Information

Except as otherwise provided in this Privacy Policy, we will keep your Personal Information private and will not share it with third parties, unless such disclosure is necessary to: (a) comply with a court order or other legal process; (b) protect our rights or property; or (c) enforce our Terms of Service. We provide you with the capability to transmit your Personal Information via secured and encrypted channels if you use a similarly equipped web browser.

6. Health Information Portability and Accountability Act (HIPAA)

FairCare is not required to comply with the privacy rules implemented under HIPAA. If you provide health information to your physician or any other provider covered by the regulations, you should discuss HIPAA implications with them.

7. User Ability to Access, Update and Correct Personal Information

In order to ensure that all of your Personal Information is correct and up-to-date, you may visit your personal profile, at www.FairCareMD.com, at any time. Through your personal profile you may: (a) review and update your Personal Information that we have already collected; or (b) choose whether or not you wish us to send you information about our company.

8. Lost or Stolen Information

You must promptly notify us if your FairCareMD user name or password is lost, stolen or used without permission. In such an event, we will temporarily deactivate that user name or password until such time as it can be verified appropriately.

9. Other Limits to Your Privacy

The Site contains links to other Web sites. We are not responsible for the privacy practices or the content of such Web sites. We may make chat rooms, forums, message boards, and news groups available to you. Please understand that any information that is disclosed in these areas becomes public information. We have no control over its use and you should exercise caution when deciding to disclose your Personal Information.

10. Children’s Privacy

We are committed to protecting the privacy of children. You should be aware that this Site is not intended or designed to attract children under the age of 18. We do not collect personally identifiable information from any person we know to be a child under the age of 18.A parent or guardian, however, may use the Site to establish a health information log for a minor. The parent or guardian assumes full responsibility for ensuring that the registration information is kept secure, supervising a minor’s use of the Site and ensuring that the information submitted is accurate.

11. Updates and Changes to Privacy Policy

We reserve the right, at any time and without prior notice, to add to, change, update or modify this Privacy Policy, simply by posting such change, update or modification on the Site. Any such change, update or modification will be effective immediately upon posting on the Site.
